Constitutional law refers to rights carved call at the federal and state constitutions. Constitutional law may be a body of law which defines the role, powers, and structure of various entities within a state, namely, the chief , the parliament or legislature, and the judiciary; also because the basic rights of citizens and, in federal countries like the us and Canada, the connection between the central government and state, provincial, or territorial governments.
Not all nation states have codified constitutions, though all such states have a just commune, or law of the land, which will contain a spread of imperative and consensual rules. These may include customary law, conventions, law, judge-made law, or international rules and norms. Constitutional law deals with the elemental principles by which the govt exercises its authority. In some instances, these principles grant specific powers to the govt, like the facility to tax and spend for the welfare of the population. Other times, constitutional principles act to put limits on what the govt can do, like prohibiting the arrest of a private without sufficient cause. In the broadest sense a constitution may be a body of rules governing the affairs of an organized group. A parliament, a church congregation, a social club, or a union may operate under the terms of a proper document labelled a constitution. Not all of the principles of the organization are within the constitution; many other rules (e.g., bylaws and customs) also exist. By definition the principles spelled call at the constitution are considered to be basic, within the sense that, until they're modified consistent with an appropriate procedure, all other rules must conform to them. Thus, the leader of a corporation could also be obliged to declare a proposal out of order if it's contrary to a provision within the constitution. Implicit in the concept of a constitution is that the idea of a “higher law” that takes precedence over all other laws. But whether it concentrates or disperses these powers, a constitution always contains a minimum of the principles that outline the structure and operation of the govt that runs the community.
